Competition Terms

These terms and conditions (the Terms) apply to all competitions and prize draws (each a Competition) run by Leeds Dance Community Radio Ltd, trading as LDC Radio (the Promoter, “we”, “us”), whether on air on 97.8 FM or DAB, on our online stream, on ldcradio.co.uk, on our apps or on our social media channels. Details of the Promoter are in section F.

Each Competition will also have its own details, such as how to enter, the closing date, the prize and any extra rules, which we give on air, on the Website, in a social media post or wherever the Competition is promoted (the Competition Information). These Terms and the Competition Information together make up the rules of the Competition. If the Competition Information conflicts with these Terms, the Competition Information applies.

By entering a Competition you agree to these rules. If you do not agree, please do not enter.

We may update these Terms from time to time. The version that applies to a Competition is the one published on this page when that Competition opens, unless a change is needed for reasons outside our control, in which case we will make it fairly and announce it where the Competition was promoted.

A General competition terms

1 Eligibility

1.1Entrants must meet the eligibility requirements in these Terms and in the Competition Information. Entries that do not meet them are invalid, and any prize will be forfeited.

1.2Unless the Competition Information says otherwise, Competitions are open to residents of the United Kingdom, the Isle of Man and the Channel Islands aged 18 or over at the time of entry.

1.3The following people may not enter: directors, staff and volunteers of the Promoter, presenters on LDC Radio, anyone involved in running the Competition or providing the prize (including their agencies), and members of their immediate families or households. Entries from them are invalid.

1.4We may ask any entrant or winner for evidence of their age, identity and eligibility, and may carry out reasonable checks on the details they give. We may hold back a prize until we receive that evidence. If it is not provided within a reasonable time, the prize may be forfeited.

2 Entry

2.1The opening and closing dates and times are given in the Competition Information. Entries received outside those times will not be counted.

2.2For a competition, entrants must answer the question or complete the task set out in the Competition Information. For a prize draw, entrants just need to submit the information asked for.

2.3Entrants may be asked for their full name, a contact telephone number, an email address and any other information set out in the Competition Information. Entrants must give accurate details, as we will use them to contact the winner.

2.4Entry to our Competitions is free. We do not run Competitions with paid or premium-rate entry, and you never need to buy anything to enter. Normal charges from your phone, mobile or internet provider may apply to calls, messages or data used to enter. Competitions run by advertisers, partners or other companies on their own websites or channels are not run by us and are covered by their own terms.

2.5Entry must be made by the method or methods given in the Competition Information, which may include:

2.5.1On air: calling or messaging the studio when invited to do so during a programme, following the presenter’s instructions. Calls to the studio may be recorded and may be broadcast.

2.5.2Online: following the instructions on the Website. Use of the Website is also subject to our Terms and Conditions.

2.5.3Social media: following the instructions in our post, for example by commenting, sharing or following. A Competition run on social media is in no way sponsored, endorsed, administered by or associated with Instagram, Facebook, X or any other platform, and entrants release those platforms from any liability connected with it. Entrants must also follow the rules of the platform they use.

2.5.4Email: sending an email to the address given in the Competition Information, including the information asked for.

2.6Unless the Competition Information says otherwise, only one entry per person per Competition is allowed. Entries made through agents or third parties, on behalf of another person, in bulk or by automated means are invalid.

2.7Entries that are incomplete, illegible, inaudible, late, over any limit on the number of entries, or not otherwise made in line with these rules are invalid.

2.8We are not responsible for entries that are lost, delayed, incomplete or not received for any reason, including technical faults with phone lines, networks, social media platforms or email.

2.9If there is any dispute about whether an answer or entry is correct or valid, or about the running of the Competition, our decision is final, acting reasonably.

3 The prize

3.1The prize is as described in the Competition Information. Unless it says otherwise, only one prize per person per Competition can be won.

3.2The prize is subject to availability and to confirmation of the winner’s eligibility. It may also be subject to the terms and conditions of the prize provider and, where relevant, of a venue, event organiser, travel provider or manufacturer.

3.3Where the prize is for an event or on a specific date, the winner must be available on that date and no alternative date will be offered. Any age restrictions of the venue or event apply.

3.4Where the prize includes travel or accommodation, it is subject to availability and to any exclusion dates, and the winner (and any companion) must hold any travel documents needed. Where travel is for more than one person, they must travel together on the same itinerary.

3.5Where a prize is to be provided directly by a third party, the winner must follow that third party’s reasonable instructions to receive it, including any time limits. If the winner does not, the prize may be forfeited.

3.6The winner (and any companion) may be asked to sign a form confirming acceptance of the prize and any related conditions. If they do not, the prize may be forfeited.

3.7The prize includes only what is stated in the Competition Information. All other costs, such as travel to an event, meals, spending money or insurance, are the winner’s responsibility unless stated otherwise.

3.8Unless the Competition Information says otherwise, prizes are collected from LDC Radio at Mabgate Business Centre, 93-99 Mabgate, Leeds, LS9 7DR, at a time agreed with the winner, or, where we agree, sent to the winner. Where a winner has to travel to collect a prize from us, we will contribute up to £100 towards their reasonable travel costs, on production of receipts or other proof of travel. Unless the prize is time-critical or the Competition Information says otherwise, the winner should collect the prize, or agree delivery with us, within 28 days of winner confirmation. If winners will receive their prizes more than 30 days after the closing date, the Competition Information will say by when.

3.9There is no cash alternative, and prizes cannot be transferred or exchanged. If a prize or part of it becomes unavailable for reasons outside our control, we may substitute a prize of equal or greater value.

3.10If the winner chooses not to take up the prize, or part of it, we may ask them to confirm this in writing, and we may then keep the prize or award it to another eligible entrant.

3.11We may refuse to award a prize, or seek its return, if the winner was not entitled to it, has broken these rules, or has acted fraudulently or dishonestly.

3.12Where a prize is posted or delivered, we are not responsible for it being lost, damaged or stolen after it has been delivered to the address the winner gave us.

4 Winner selection

4.1Where the winner is chosen at random, the draw will take place on or after the closing date given in the Competition Information, from all valid entries (and, where there is a question, all correct answers). The winner will be picked either by a computer process that selects at random, or by hand by a person who is independent of the Competition (not the presenter running it or anyone connected with the entries), or under that person’s supervision. We keep a record of each draw, including the date, the number of valid entries, the method used and who made or supervised it.

4.2Where the winner is chosen by judging, the Competition Information will set out the judging criteria. Judging will be carried out fairly by a panel chosen by us, and the judges’ decision is final.

4.3Where a Competition is won live on air, the winner is the first eligible caller or entrant to meet the requirement announced by the presenter.

5 Winner contact

5.1We will contact the winner as soon as practicable after the draw or judging, using the contact details they gave when entering, or through the social media platform they entered on. We will never ask a winner for bank details, card details or a payment to claim a prize.

5.2Unless the Competition Information says otherwise, the winner must reply within 28 days of our first attempt to contact them, and we will make reasonable efforts to reach them during that period. Where the prize is time-critical (for example, tickets for an event soon after the closing date), the Competition Information will set a shorter period and say how and when we will try to contact the winner.

5.3If we cannot reach the winner within the relevant period, or the winner does not meet the eligibility requirements or does not follow these rules, the prize may be forfeited and we may offer it to another eligible entrant chosen in the same way.

5.4The winner (and any companion) must follow any reasonable directions from us, the prize provider or their agents, and all relevant laws and rules when taking up the prize.

B Fair play

6.1We are committed to running Competitions fairly and to preventing misuse of our systems.

6.2We may disqualify entries where we have reasonable grounds to suspect that anyone has tried to manipulate the result, for example by making or disguising multiple entries, using automated or bulk entry, using fake or multiple social media accounts, or otherwise breaking these rules.

C Liability

7.1Nothing in these rules affects your statutory rights as a consumer. For advice on your rights, you can contact Citizens Advice.

7.2Nothing in these rules excludes or limits our liability for death or personal injury caused by our negligence or that of our staff, volunteers or agents, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law.

7.3Subject to 7.1 and 7.2, we are only responsible for loss or damage that is a foreseeable result of our breaking these rules or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for business losses.

7.4Subject to 7.1 and 7.2, we are not responsible for the prize itself where it is provided by a third party; any issue with the quality or delivery of such a prize should be raised with the prize provider, and we will help where we reasonably can.

7.5Subject to 7.1 and 7.2, we may change, suspend or cancel a Competition, or change its closing date, where this is needed for reasons beyond our reasonable control, such as technical failure, the unavailability of a prize, an event being cancelled, severe weather, illness, or a change in the law or a direction from a regulator. We will announce any change where the Competition was promoted, and act fairly towards entrants.

7.6Subject to 7.1 and 7.2, we will not refund any cost of entering a Competition, such as call or data charges.

D Privacy

8.1We use the personal data you give when entering a Competition to run the Competition, check eligibility, contact the winner and deliver the prize. Our lawful basis is performance of these rules as an agreement with you.

8.2We share a winner’s details with the prize provider only where needed to deliver the prize. Where the prize provider is outside the UK, we will make sure the transfer is protected as described in our Privacy Policy.

8.3Entering a Competition does not sign you up to our newsletter or any other marketing. We will only send you our newsletter if you separately sign up and confirm your subscription.

8.4Unless the Competition Information says otherwise, we keep entries for 6 months after the winner is confirmed and then delete them. We keep winners’ names, towns, prize details and the date they won for 2 years, to show that the Competition was run fairly.

8.5We may announce the winner’s first name and town on air, on the Website and on our social media. For major prizes we will also give the winner’s surname and county to anyone who asks under 10.2, to show that the prize was genuinely awarded. If you do not want your details announced or given out, or want less shared, you can tell us when you enter or when we contact you; we may still need to give the winner’s details and winning entry to the Advertising Standards Authority or another regulator if asked. Any further publicity, such as photographs, interviews or quotes, is optional and will only be used with the winner’s agreement.

8.6Calls to the studio may be recorded, and may be broadcast, to capture entries and for quality and compliance purposes.

E General

9.1Entering a Competition does not create any employment, agency or commercial relationship between you and us.

9.2If any part of these rules is found to be invalid or unenforceable, the rest will continue to apply.

9.3These rules are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your home courts and rely on the law of your home country.

  • (a) your name;
  • (b) your email address or phone number;
  • (c) the name of the Competition and where you entered it (on air, on the Website or on which social media platform); and
  • (d) the date and time you entered and details of your question or problem.

We will reply as soon as we can. If you need these Terms or any Competition Information in a different format, please email hello@ldcradio.co.uk and we will do our best to help.

10.2For the name of the winner of a Competition (for major prizes, their surname and county), or a copy of the Competition Information for a particular Competition, email hello@ldcradio.co.uk within 3 months of the closing date, giving the name of the Competition.

10.3The Promoter is Leeds Dance Community Radio Ltd (company number 11013547), whose registered office is at Mabgate Business Centre, 93-99 Mabgate, Leeds, LS9 7DR. These rules apply between you and Leeds Dance Community Radio Ltd, unless the Competition Information names a different promoter.
