1. About us and these terms

LDC Radio is owned and operated by Leeds Dance Community Radio Ltd (“LDC Radio”, “we”, “us”, “our”), a private company limited by guarantee without share capital, registered in England and Wales with company number 11013547. Our registered office is Mabgate Business Centre, 93-99 Mabgate, Leeds, LS9 7DR.

LDC Radio is a community radio station for Leeds and West Yorkshire, broadcasting on 97.8 FM and DAB, and available through our online stream and our mobile apps. You can contact us at hello@ldcradio.co.uk.

These terms apply to your use of ldcradio.co.uk (the “Website”), including listening to our live stream and on-demand content through the Website. By using the Website you agree to these terms. If you do not agree, please do not use the Website.

Other terms may also apply to particular things you do with us:

• our Privacy Policy explains how we use your personal data;
• our Competition Terms and Conditions apply to competitions and prize draws we run; and
• presenters, advertisers and anyone booking a slot with us will have their own agreement or booking terms with us, which take priority over these terms where they differ.

2. Using the Website

You may use the Website for lawful purposes only. You must not:

• use the Website in any way that breaks the law or infringes anyone else’s rights;
• try to gain unauthorised access to the Website, the servers it runs on or any connected system, or interfere with how it works (for example by introducing viruses or by overloading it with automated requests);
• copy or collect content from the Website by automated means (“scraping”) without our written permission; or
• submit anything through the Website that is false, offensive, defamatory, or that you do not have the right to share.

We try to keep the Website available and accurate, but we do not guarantee that it, or any content on it, will always be available, uninterrupted, error-free or up to date. We may change, suspend or withdraw any part of the Website without notice, for example for maintenance or for reasons outside our control.

Content on the Website, including news articles, schedules and show information, is provided for general information only. It is not advice, and schedules can change at short notice.

3. The live stream and on-demand content

You can listen to LDC Radio live through the player on the Website, and to recorded shows, mixes and podcasts on demand. The live stream is delivered from our own streaming server; some on-demand content is played through embedded players provided by third parties such as Mixcloud, SoundCloud, YouTube and Spotify.

The live stream and on-demand content are provided for your personal, non-commercial listening only. Unless you have our written permission (and, where needed, the permission of the other rights holders), you must not:

• record, download, copy or rebroadcast the stream or any programme, except as the relevant player itself allows;
• play the stream or our content in a public or commercial setting, such as a shop, bar, gym or event; or
• embed, relay or re-publish the stream on another website, app or service.

The music we broadcast is licensed for our own broadcasting and streaming. Those licences do not extend to your reuse of it. Playing radio in a business may require your own licence (for example from PPL PRS).

Listening online uses data. If you listen on a mobile network, your provider’s data charges apply. We cannot guarantee that the stream will be available at all times or in every location.

4. Things you send us

You can send us information through the Website and our related services. When you do, you confirm that what you send is accurate, is yours to share and does not break the law or anyone else’s rights. How we handle any personal data you provide is explained in our Privacy Policy.

Enquiry and advertising forms

Messages sent through our contact and advertising enquiry forms go to the station’s inbox, where a member of our team will read and reply to them. You will receive an automatic email acknowledging your message. Sending an enquiry does not create any agreement between you and us; any advertising or sponsorship is agreed separately in writing.

Newsletter

If you join our mailing list, we will send you an email asking you to confirm your subscription. We only send the newsletter once you have confirmed. Every newsletter contains a link to unsubscribe, and you can also unsubscribe at any time by emailing hello@ldcradio.co.uk.

Texts and shout-outs to the studio

You can message the studio by WhatsApp on +44 7360 928760 or by email to studio@ldcradio.co.uk. Messages may be read out on air, and we choose which messages to use. Please do not send anything unlawful, offensive or private, and do not text while driving. For anything other than texts and shout-outs, please email hello@ldcradio.co.uk.

LDC Introducing bookings

Artists and DJs can request a slot on LDC Introducing through our booking page at app.ldcmusic.co.uk/book. A request is not a confirmed booking: each request is reviewed by one of our directors, and a slot is only confirmed when we send you a confirmation email with a calendar invitation. We may decline or reschedule a request.

Guests must be 16 or over. A guest aged 16 or 17 can only appear if a parent or guardian has agreed to the booking and stays with them at the studio for the whole slot. By accepting a slot, you agree to:

• follow the instructions of the presenter and our team, including signing in and out of the studio;
• keep everything you say and play within the Ofcom Broadcasting Code and the law, which means no offensive or sexually explicit language or lyrics, nothing that encourages violence or crime, no hateful or abusive comments about anyone, and nothing defamatory;
• not advertise or promote any brand, product, company or event on air unless we have agreed it with you beforehand, and never in return for payment or any other benefit given to you; and
• not come to the studio under the influence of alcohol or drugs, or drink alcohol or take drugs on our premises.

If a guest breaks these conditions, we may take them off air, end the slot early and cancel any future bookings.

DJ and presenter applications

Applications to present or DJ on LDC Radio are currently made through a Google Form linked from the Website. Submitting an application does not guarantee a show. Presenters who join the station agree separate terms with us, and a presenter’s public profile only appears on the Website after the presenter has submitted it and a director has approved it.

Material you supply

If you send us images, audio, video, text or other material for use on air, on the Website or on our social media (including a presenter profile or promotional material), you keep ownership of it, but you give us a non-exclusive, royalty-free licence to use, edit, broadcast and publish it in connection with LDC Radio for as long as it is in use. You confirm that you own the material or have all the permissions needed, including from anyone who appears in it. We may remove any material at any time, and we will remove material that we reasonably believe infringes someone else’s rights.

5. Intellectual property

The Website and its content, including its design, text, graphics, logos, programmes, recordings and software, are owned by or licensed to Leeds Dance Community Radio Ltd, or are used with the permission of their owners. “LDC Radio” and our logos are our brand and may not be used without our written permission.

You may view the Website and print or save a reasonable number of pages for your own personal, non-commercial use. Otherwise, you must not copy, reproduce, distribute, sell or adapt any content without the prior written permission of the rights holder.

6. Third-party websites, players and services

The Website links to, and includes content from, services we do not control, including:

• embedded players from Mixcloud, SoundCloud, YouTube and Spotify;
• the Apple App Store and Google Play, where our apps can be downloaded;
• Google Forms, which we currently use for DJ and presenter applications;
• our social media pages and WhatsApp; and
• the websites of artists, partners, advertisers and other organisations.

Those services have their own terms and privacy policies, which apply when you use them. A link or embed is not an endorsement, and we are not responsible for the content, availability or practices of third-party services.

Our mobile apps, “LDC Radio 97.8FM”, are downloaded from the Apple App Store and Google Play, and their use is also subject to the store’s terms. On Google Play the app is published by Leeds Dance Community Radio Ltd; on the App Store it is published under the name of one of our directors on behalf of the station. The apps do not have separate terms: these terms apply to your use of the apps as they do to the Website, and the apps are covered by our Privacy Policy.

7. Our responsibility to you

If you use the Website as a consumer, nothing in these terms affects your legal rights, and we do not exclude or limit our liability where it would be unlawful to do so. In particular, we do not exclude or limit our liability for:

• death or personal injury caused by our negligence or the negligence of our staff, volunteers or agents;
• fraud or fraudulent misrepresentation; or
• any other liability that cannot be excluded or limited under the law of England and Wales, including your rights under the Consumer Rights Act 2015.

Subject to that, the Website, the stream and our on-demand content are provided free of charge for personal use, and:

• we are only responsible for loss or damage that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill; we are not responsible for loss or damage that is not foreseeable;
• we are not responsible for any business losses, such as loss of profit, revenue, business opportunity or data, as the Website is provided for domestic and private use; and
• we are not responsible for interruptions to the stream or the Website, or for the content or availability of third-party services.

We take reasonable steps to keep the Website secure, but you should use your own virus protection when using any website.

If you use the Website on behalf of a business, you agree to compensate us for reasonable losses and costs we suffer as a direct result of that business breaking these terms.

8. Complaints

About the Website or our service

If you have a problem with the Website or with how we have dealt with you, please email hello@ldcradio.co.uk with your name, a way to contact you and details of the problem. We aim to reply within 28 days.

About something broadcast on LDC Radio

We take complaints about our programmes seriously. Please email hello@ldcradio.co.uk as soon as possible, giving the date, approximate time and programme, and a description of what concerned you. Include your full name and contact details so we can respond. We aim to investigate and respond within 28 days. You can also complain to Ofcom, the UK regulator for broadcasting, using its Complain about TV, radio or on demand services page. You do not have to wait for our reply before contacting Ofcom, and Ofcom normally asks for complaints about a programme to be made within 20 working days of it being broadcast. 9. Changes to these terms

We may update these terms from time to time, for example to reflect changes to the Website, our services or the law. The version on this page applies from the “Last updated” date shown. Please check this page when you use the Website. If a change significantly affects something you have already signed up for, such as the newsletter or a booking, we will tell you by email.

10. General

If a court decides that any part of these terms is invalid or unenforceable, the rest of the terms will continue to apply. If we do not enforce any of these terms straight away, we can still enforce them later. These terms are between you and us; no one else has any right to enforce them.

These terms are governed by the law of England and Wales. You and we both agree that the courts of England and Wales will have jurisdiction, except that if you live in Scotland or Northern Ireland you may also bring proceedings in your home courts.
